Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by Mind Byte (ABN 54739757159) ("we", "us", or "our"), including domain registration, web hosting, email hosting, and related services (the "Services"). By creating an account or using the Services, you agree to be bound by these Terms.
Mind Byte is operated from Australia, and these Terms are governed by the laws of Australia. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).
1. Your Account
You must provide accurate, current, and complete information when creating an account and keep this information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, including activity by other users you invite to your organisation.
2. Domain Registration Services
Domain registrations are subject to the policies of the relevant domain registry and registrar, including ICANN policies for generic top-level domains and auDA policies for .au domains. By registering a domain through us, you agree to the applicable registrant agreement for that domain's registry.
Domain registration, renewal, and transfer fees are non-refundable once the registry has processed the request, except where required by the Australian Consumer Law.
You are responsible for renewing your domains before they expire. We will send renewal invoices in advance of expiry, but ultimate responsibility for timely renewal rests with you.
WHOIS privacy services are not available for
.audomains under current auDA policy.
3. Hosting and Email Services
Hosting and email services are provisioned on a subscription basis and billed in advance for each billing period. You must not use the Services to store or transmit unlawful content, send unsolicited bulk email, or otherwise breach the acceptable use policies of our underlying infrastructure providers.
4. Fees, Billing, and Late Payment
Fees for the Services are set out at the time of purchase and are payable in advance unless otherwise stated. If a renewal invoice remains unpaid after the due date, we may:
mark the invoice as overdue after a grace period;
suspend the relevant hosting or email service after a further grace period; and
terminate a suspended service, and disable domain auto-renewal, if payment is not received within the periods described in your account dashboard or invoice.
Suspension or termination for non-payment does not relieve you of the obligation to pay fees already incurred.
5. Cancellations and Refunds
Our refund practices are described in our Refund Policy, which forms part of these Terms.
6. Acceptable Use
You must not use the Services to engage in unlawful activity, infringe the intellectual property or privacy rights of others, distribute malware, or interfere with the proper operation of our infrastructure or that of third parties. We may suspend or terminate the Services, with or without notice, if we reasonably believe you have breached this section.
7. Liability
To the maximum extent permitted by law, and subject to the consumer guarantees under the Australian Consumer Law that cannot be excluded, our liability to you for any loss arising from or in connection with the Services is limited to the amount you paid for the relevant Service in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits or data.
8. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as by email or an in-app notice. Continued use of the Services after such changes take effect constitutes acceptance of the updated Terms.
